SANTO DOMINGO, República Dominicana.- La Cámara de Diputados recibió del vicepresidente Ejecutivo del Consejo de Directores de la Fundación Institucionalidad y Justicia, (FINJUS), Servio Tulio Castaños Guzmán, las observaciones realizadas al Proyecto de Código Penal que actualmente se tramita en el Congreso.
Castaños Guzmán destacó que este es el resultado de múltiples sesiones de trabajo de la Comisión de Alto Nivel en Materia Penal conformada para el efecto a petición de la Cámara de Diputados.
“Los trabajos de reforma propuestos han estado orientados, esencialmente, en la actualización de la pieza legislativa como instrumento indispensable para la consecución de una política criminal verdaderamente efectiva al momento de enfrentar las novedosas formas y esquemas delincuenciales. Las propuestas que hoy presentamos de modificación al Código Penal ponen de manifiesto las valoraciones jurídica-sociales, los vacíos, las contradicciones y las deficiencias de las disposiciones legales de nuestro actual Código Penal”, expresa Castaño.
Estas observaciones, añade, afinan aspectos para el entramado jurídico penal como son, la responsabilidad penal de las personas jurídicas y el cúmulo de penas como respuesta al crimen organizado nacional y transnacional.
También la definición de infracciones graves contra el patrimonio público, lo que no existía como tipo penal. Ejemplo de ello, dice, la proscripción de la corrupción, el enriquecimiento ilícito, la modificación del tipo penal del cohecho de funcionarios y auxiliares de justicia, el pago irregular de contratos administrativos, la sobrevaloración, entre otros.
