Paula Disla, presidenta ejecutiva del Consejo Nacional para la Niñez y la Adolescencia (Conani), afirmó que se pone en peligro una vez más la decisión de sacar del Código Civil los artículos 144 y 145 que permiten el matrimonio infantil en el país.
Expresó que debido a las declaraciones surgidas por algunos diputados el pasado miércoles decidieron acudir al Congreso Nacional a reunirse con los miembros de la comisión de justicia que estudia la prohibición en su totalidad de las uniones de los menores de edad y que afecta principalmente a las niñas.
“Nuestro objetivo es orientar a que las decisiones de la Cámara de Diputados sean las correctas, las cuales son las que benefician a los niños, niñas y adolescentes para que su vida no se vean interrumpidos por decisiones de adultos mal tomadas”, señaló Disla.
La funcionaria considera que la propuesta que permitiría el matrimonio infantil en menores de 16 años de edad, siempre que la pareja no le supere en cinco años, lo que es una dispensa y que califica de “un abuso”.
“La ley hasta ahora mantiene esos cinco años y nos parece mucho para esas uniones, pero es preferible que se mantengan esos cinco años a aumentarlos a ocho este permiso”, dijo.
Disla aseguró que no hay ninguna diferencia entre lo que es un infante, niño y adolescente como lo expresaron algunos diputados y que a partir de eso es que ellos se basan en tomar la decisión para permitir el matrimonio a partir de los 16 años.
“Niñez es la persona de 0 a 18 años y esa etapa se divide en niño y niña de 0 a 12 años y de 13 a 18 años es que ese niño pasa a ser adolescente”, explicó la directora de Conani.
La representante en el país de Unicef, Rosa Elcarte, catalogó la propuesta para el matrimonio infantil como una “barbaridad”, debido a que este lo han debatido varias veces en el Congreso Nacional y que ahora con un nuevo Gobierno se vuelva a decir que las niñas puedan contraer matrimonio a los 16 años con adultos.
Dijo que bebés, niños y adolescentes están acogidos bajo la Convención sobre de los Derechos del Niño que es hasta los 18 años y por lo tanto deben estar protegidos.
Señaló que una niña de 16 años que se case con alguien mayor no tiene la protección debida y no tiene capacidad física y psicológica para tomas decisiones por lo que es necesario dejar que las mismas maduren y que sean adulta para poder elegir lo que es mejor para ellas.
“Las están matando, abusando, violando. Y hay personas que dicen que como ya quedaron embarazadas… Si quedaron embarazadas es porque es parte del abuso”, explicó Elcarte.
Eduardo Gallardo, representante de Unicef también, manifestó que el Tribunal Constitucional está revisando la constitucionalidad de las excepciones al matrimonio de los 18 años.
Gallardo expuso que conforme a lo que dice el la legislación internacional, el matrimonio infantil es considerado como unas de las práctica más atroces de violencia contra la mujer.
