La crisis generada por la pandemia en el mercado laboral ha obligado a la utilización de distintos modelos de trabajo a distancia en tiempo récord, así lo destacó el ministro de Trabajo durante el Desayuno del Listín Diario, revelando que elaboran una resolución para regular, en la medida de lo posible, la modalidad del teletrabajo.
Al conversar con los ejecutivos de la Editora Listín Diario, Manuel Corripio y Héctor Rizek, con el director y el subdirector de este diario, Miguel Franjul y Fabio Cabral, el ministro explicó que se pretende regular, siempre sobre la base que lo permita el Código de Trabajo, las relaciones laborales entre trabajadores y empleadores.
Refirió que este viernes sostendrá un encuentro en el Consejo Consultivo del Trabajo, para identificar cuáles son las principales preocupaciones, tanto del sector empleador como del trabajador, y con esto construir una resolución que sirva como marco regulador apegado lógicamente a lo que establece el Código Laboral.
Expuso que estas nuevas modalidades de trabajo surgidas por la pandemia es un elemento más para que se retome el diálogo tripartito para la modificación del Código que se ha mantenido entrampado por las posturas enfrentadas del sector patronal y el sindical por la figura de la cesantía.
El funcionario se mostró partidario de una flexibilización de las jornadas laborales, siempre bajo el acuerdo libre y voluntario tanto del empleador como del trabajador y siempre respetando los derechos de estos últimos.
Asimismo, De Camps García señaló que se debe abordar, en el caso del teletrabajo, una serie de temas como el tiempo de trabajo, los accidentes laborales, a quién le corresponde y también quién debe suministrar las herramientas y los gastos en que se incurren en el trabajo en la casa, como la energía eléctrica, el servicio de internet, entre otros.
Transformar la institución en el ministerio del empleo
Ante los nuevos desafíos que impone la transformación del mercado laboral, el nuevo ministro de Trabajo, De Camps García, se propone impulsar una transformación estructural del ministerio para convertirlo en el Ministerio de Empleo, Protección, Desarrollo y Seguridad Social.
Con esta iniciativa, el funcionario indicó que trabajan en un anteproyecto de ley que pueda unificar y propiciar mayor nivel de coordinación de la política laboral tanto a nivel de promoción del empleo, como del desarrollo de capacidad, generación de oportunidades y seguridad social.
“Actualmente el Estado Dominicano tiene una cantidad de iniciativas e instituciones que no siempre trabajan de manera coordinada, por ejemplo a nivel de protección social se encuentra el Gabinete de Políticas Sociales (…), una serie de instituciones que hacen una gran labor, pero que no están hoy coordinadas con lo que es el principio y fin de esas labores, el principio es el empleo y el final es el empleo”, manifestó De Camps.
El funcionario explicó que la idea es que todas las acciones sociales y políticas que se generen desde el Estado apunten a la protección social y a la empleabilidad.
De Camps García también se propone crear una Red de Fomento y Generación de Empleo, con todo el sector empleador para visualizar las necesidades en el mediano y largo plazo para una mejor labor de intermediación laboral del Ministerio y la definición de políticas y recursos para lograr mayores niveles de empleabilidad.
En este proyecto, el ministro establece que propiciará la creación de una Bolsa Digital de Empleo, donde a través de aplicaciones tecnológicas se puedan tener en tiempo real la disponibilidad de plazas de trabajo en todo el territorio nacional y también las ofertas de recursos humanos capacitados.
“Actualmente esa labor se realiza con mecanismos más artesanales, que impiden la eficiencia del mismo. Uno de nuestros objetivos con ese programa es poder dotar a los ciudadanos y al empleador desde su computadora o teléfono inteligente, entrar a la aplicación, ingresar sus informaciones, crear sus perfiles con sus competencias y experiencias y automáticamente se identifican oportunidades.
Dijo que para esto se buscará alianzas con el sector empresarial para alimentar esa base de datos digital y también se integrarán las oportunidades que se generen en el sector público. Agregó que ya se han realizado conversaciones con empresas que han desarrollado sus propias redes de información sobre oportunidades de empleos.
Dice es un gran reto aplicar el 80/20
Al referirse a la aplicación del artículo 135 del Código Laboral que establece que el 80% de los empleos deben ser otorgados a dominicanos y solo el 20% a personal extranjero, el ministro de Trabajo, De Camps García, admitió que es un gran reto en la actualidad.
Expuso que este tema tiene un componente de control migratorio, pero que evidentemente que se necesita establecer diálogos con la agroindustria y el sector construcción para conocer bien la realidad y establecer acuerdos que permitan mayor control de la mano de obra que se contrata.
Agrega que desde las directrices del presidente de la República, Luis Abinader, se ha establecido que es necesario buscar soluciones a este tema y fomentar la dominicanización de la mano de obra.
Como dato, el ministro señaló que existen trabajadores extranjeros legales (haitianos, venezolanos) acogidos a FASE, pero no precisó cuántos.
Lucha contra el trabajo infantil
Como una de sus prioridades, De Camps García mencionó el tema del trabajo infantil, tras destacar que se coordinan acciones con instituciones como el Consejo Nacional de la Niñez (Conani) y la Procuraduría General de la República para reducir este flagelo que afecta a la infancia.

Las dificultades para identificar los recursos que sostengan la ayuda que ofrece el Gobierno a través del Fondo de Asistencia Solidaria al Empleador (FASE) podrían dejar sin amparo a partir del próximo año a ciento de miles de trabajadores.
El ministro de Trabajo, Luis Miguel de Camps García apuntó que la apuesta es a la reactivación económica. Expuso en la actualidad quedan 294,383 en FASE 1 y 497,384 en FASE 2.
