Propuestas sobre salario de Navidad enfrenta al Gobierno con los trabajadores

Santo Domingo, RD. – Las propuestas vertidas por el Gobierno sobre el pago del salario 13 ha encontrado la oposición firme de representantes de los trabajadores, mientras el sector empresarial expone estar dispuesto a cumplir con el Código de Trabajo, señalando que establece que el pago se hace sobre la base de los salarios devengados y que “los trabajadores suspendidos no devengan salario”.

Aunque todos los sectores apuestan a un entendimiento en el diálogo tripartito o en el Consejo Consultivo de Trabajo, lo cierto es que mantienen posturas que tendrán que ser bien ponderadas para que se logre llegar a un acuerdo que no sobrecargue las posibilidades del Gobierno, que no perjudique al sector empleador y que garantice que los trabajadores reciban el alivio navideño que representa la regalía pascual.

El vicepresidente ejecutivo del Consejo Nacional de la Empresa Privada (Conep), César Dargam, manifestó que aunque no tienen ninguna propuesta al respecto están abiertos al diálogo en función de lo que establece el Código de Trabajo y cita  “Art. 219.- El empleador está obligado a pagar al trabajador en el mes de diciembre, el salario de Navidad, consistente en la duodécima parte del salario ordinario devengado por el trabajador en el año calendario, sin perjuicio de los usos y prácticas de la empresa, lo pactado en el convenio colectivo o el derecho del empleador de otorgar por concepto de éste una suma mayor”.

Dargam expresa que el Código establece que el pago se hace sobre la base de los salarios devengados y que los trabajadores suspendidos no devengan salario. “El ministro ha sido responsable y mostrado liderazgo al convocar el diálogo tripartito. Por eso es que es importante que fluya el diálogo para que sobre la base de lo que establece el código se exploren posibilidades”, indicó planteando que se debe generar un ambiente favorable para proteger, mejorar y generar empleos en medio de esta crisis.

En tanto, los representantes del sector sindical exigen al Gobierno que se mantenga sin gravamen el salario 13 y que busque una solución para los trabajadores, suspendidos o no, para que tengan garantía de que recibirán el sueldo trece completo.

“A los que hay que gravar es a los ricos que poseen fortunas, los que han ganado dinero con el crecimiento económico que ha tenido República Dominicana, pero no a la clase media y a los más pobres», opina Jacobo Ramos, presidente de la Confederación Nacional de Trabajadores Dominicanos (CNTD).

Rafael Pepe Abreu, presidente de la Confederación Nacional de Unidad Sindical (CNUS), expresó que el ministro de Trabajo, Luis Miguel De Camps,  tiene en sus manos todas las posibilidades para que desde el diálogo tripartito se encuentren las alternativas equilibradas a la situación laboral porque tanto el empresariado como las centrales sindicales están de acuerdo en que es vital resolver el problema de los trabajadores suspendidos y lo del salario 13.

Expuso que en la actualidad 300,400 empleados privados permanecen con sus contratos de trabajo suspendidos y que están recibiendo la ayuda del Fondo de Asistencia Solidaria al Empleado (FASE). Dijo que la voluntad expresada por las partes hace más fácil encontrar soluciones sobre todo apelando a fondos públicos y aporte del sector empresarial.

Agrega que el tema de apegarse a lo que plantea el Código de Trabajo con el tema del salario 13 implicaría que los trabajadores suspendidos apenas recibirán una tercera parte de lo que cobraban antes de la pandemia como doble sueldo o salario 13 y esto llenará de frustración no solamente al trabajador, sino que afectará a sus familias.

“Todo el mundo sabe que ese doble sueldo es que la clase trabajadora alivia sus deudas y aprovecha para comprar cosas que necesita la familia y que en otra época no puede resolver.  Además, hay una tradición en las familias dominicanas que se vería seriamente afectada y hasta la dinámica comercial se vería muy afectada”, puntualizó el sindicalista.
